1. Acceptance of Terms
By downloading, installing, or using Migraine Me ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App. You represent that you are at least 18 years of age, or that you are at least 13 years of age and have your parent's or guardian's permission to use the App.
2. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal iOS devices
- Use the App for your personal, non-commercial health tracking purposes
- Access the features and functionality of the App
License Restrictions
You may NOT:
- Copy, modify, or create derivative works of the App
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or redistribute the App
- Remove any copyright or proprietary notices from the App
- Use the App for any illegal or unauthorized purpose
- Use the App to provide medical services or diagnoses to others
- Attempt to gain unauthorized access to any part of the App
3. Medical Disclaimer and Intended Use
3.1 Not a Medical Device - Statistics Only
Migraine Me is a statistical tracking tool, not a medical device. The App:
- ONLY displays statistics and patterns from your entered data
- Does NOT diagnose medical conditions
- Does NOT provide medical treatment recommendations or advice
- Does NOT replace professional medical advice
- Does NOT predict or prevent migraine episodes with medical certainty
- Is NOT intended for use in medical emergencies
- Does NOT analyze your data to provide health recommendations
3.2 Consult Healthcare Professionals
You agree that:
- You will consult with qualified healthcare professionals for all medical decisions
- Any statistical data from the App should be discussed with your doctor for their professional interpretation
- You will not change medications or treatments based solely on app data without medical consultation
- You understand the App is a data recording tool only, not a replacement for professional medical care
3.3 Medical Emergencies
If you are experiencing a medical emergency, call emergency services immediately. Do not rely on this App.
3.4 Statistical Information Only
The App displays statistical information based on the data you enter. It shows counts, averages, and trends but does NOT interpret these statistics or provide medical insights. Individual experiences with migraines vary greatly. Always work with qualified healthcare professionals to interpret your data and develop a treatment plan appropriate for you.
3.5 No Guarantee of Outcome
We do not guarantee that using the App will improve your health, help you manage your migraines, or lead to any specific health outcome. The App is a passive recording tool only. Your health outcomes depend on your unique medical condition and the professional care you receive.
4. Premium Subscription
4.1 Subscription Details
Migraine Me offers an optional Premium Subscription with the following terms:
- Product Name: Premium Subscription
- Duration: 1 month (auto-renewable)
- Price: As displayed in the App Store (varies by region)
- Features: Advanced tracking features, detailed analytics, unlimited entries, and export options
4.2 Auto-Renewal
Your subscription will automatically renew each month unless you cancel it at least 24 hours before the end of the current billing period. You will be charged for renewal within 24 hours prior to the end of the current period.
4.3 Managing Your Subscription
You can manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase. You can also access subscription management through:
- iOS Settings → Your Name → Subscriptions
- App Store → Account → Subscriptions
- The "Manage Subscription" button in the Migraine Me app settings
4.4 Cancellation
You may cancel your subscription at any time. If you cancel:
- You will retain premium access until the end of your current billing period
- No refund will be provided for the remaining time in the current period
- Your subscription will not renew for the next period
- Premium features will become unavailable after the subscription expires
- Your data remains accessible (all data is yours regardless of subscription status)
4.5 Free Trial
If a free trial is offered, you will be charged the subscription price when the trial period ends unless you cancel before the trial expires. Trial eligibility is determined by Apple and may be limited to one trial per Apple ID.
4.6 Price Changes
We reserve the right to change subscription prices at any time. Price changes will take effect at the start of your next subscription period after the change. We will provide advance notice of any price changes through the App Store.
5. Payment
All payments are processed through the Apple App Store. By subscribing, you agree to:
- Pay the subscription fee through your App Store account
- Provide accurate and complete billing information to Apple
- Authorize Apple to charge your chosen payment method
We do not have access to your payment information. All payment disputes should be directed to Apple.
6. Refunds
All sales are final. Refunds are handled by Apple according to their refund policy. To request a refund:
- Go to reportaproblem.apple.com
- Sign in with your Apple ID
- Find your Migraine Me subscription purchase
- Select "Report a Problem" and follow the instructions
Refund approval is at Apple's discretion and subject to their policies.
7. Your Data
7.1 Data Storage
All content you create in Migraine Me (migraine logs, medications, symptoms, notes) is stored in:
- Your device's local storage
- Your personal iCloud account (if iCloud sync is enabled)
We do not have access to, control over, or responsibility for your health data.
7.2 Data Ownership
You own your health data. All information you track in Migraine Me belongs to you. You can:
- Export your data at any time
- Share your data with healthcare providers
- Delete your data permanently
- Move your data to other applications
7.3 Data Backup
You are solely responsible for backing up your health data. We recommend:
- Keeping iCloud sync enabled
- Regularly backing up your iOS device
- Periodically exporting your data using the export feature
- Keeping copies of important medical information
7.4 Data Loss
We are not liable for any data loss that may occur, including but not limited to:
- Device failure or loss
- iCloud account issues
- App deletion or reinstallation
- iOS updates or bugs
- User error or accidental deletion
- Data corruption
Important: While we strive to protect data integrity, you should maintain backups of critical health information.
8. Accuracy of Information
You are responsible for:
- Entering accurate information into the App
- Verifying the accuracy of your tracked data
- Correcting any errors in your entries
- Understanding that app-displayed statistics are calculations based on the data you provide
We are not responsible for decisions made based on inaccurate data entry or app statistics.
9. Privacy
Your privacy is critically important, especially for health data. Please review our Privacy Policy to understand how we handle your information. By using the App, you also agree to our Privacy Policy.

10. Intellectual Property
The App and all its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. The Migraine Me name, logo, and all related names, logos, and product names are trademarks.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Medical accuracy or reliability
- Non-infringement
- Accuracy, reliability, or completeness of health tracking
We do not warrant that:
- The App will meet your health tracking needs
- The App will be uninterrupted, timely, secure, or error-free
- Any statistical calculations displayed by the App are error-free or medically meaningful
- Any defects in the App will be corrected
- The App is free of viruses or other harmful components
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Any health decisions made based on App data
- Any medical conditions not properly tracked or identified
- Any unauthorized access to or use of your health data
- Any bugs, viruses, or other harmful code
- Any content obtained from the App
- Any errors, mistakes, or inaccuracies of tracking
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.
Medical Limitation: We are specifically not liable for any medical outcomes, healthcare decisions, or health conditions related to your use of the App.
13. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any medical decisions or healthcare outcomes related to your use of the App
14. Termination
We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the App will immediately cease
- You must delete the App from all your devices
- Active subscriptions will be handled according to Apple's policies
- Your data in iCloud remains yours (we never had access to it)
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by:
- Posting the new Terms in the App
- Updating the "Last Updated" date
- Providing notice through an app update (for material changes)
Your continued use of the App after changes become effective constitutes acceptance of the new Terms.
16. Apple Requirements
This App is available through the Apple App Store. You acknowledge and agree that:
- These Terms are between you and us, not Apple
- Apple is not responsible for the App or its content
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for addressing any claims you have relating to the App
- Apple is a third-party beneficiary of these Terms and has the right to enforce them
- Apple is not responsible for any health-related features or medical accuracy
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.
18. Dispute Resolution
Any disputes arising from these Terms or your use of the App should first be addressed by contacting us. If we cannot resolve the dispute informally, you agree that any legal action or proceeding shall be brought exclusively in the courts of Sweden.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
