Terms of Use (EULA) for Air Mustache Man

1. Acceptance of Terms

By downloading, installing, or using Air Mustache Man ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App. You represent that you are at least 18 years of age, or that you are at least 4 years of age and have your parent's or guardian's permission to use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal iOS devices
• Use the App for your personal, non-commercial entertainment purposes
• Access the features and functionality of the App

License Restrictions

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Remove any copyright or proprietary notices from the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the App
• Use cheats, exploits, or unauthorized modifications

3. Game Content and Fair Play

3.1 Entertainment Purpose

Air Mustache Man is provided solely for entertainment purposes. It is designed as a casual arcade game suitable for players of all ages.

3.2 Fair Play

You agree to:

• Play the game fairly without using exploits or cheats
• Not manipulate game mechanics or scores inappropriately
• Respect the intended gameplay experience

4. Optional Contributions

4.1 Free Gameplay

Air Mustache Man is fully playable for free. All core gameplay features are available without payment. Optional contributions are available to support development.

4.2 Contribution Details

If you choose to make optional contributions:

• Contributions are processed through the Apple App Store
• Contribution types and prices are displayed in the App
• Contributions help support ongoing development

4.3 Managing Contributions

You can manage contributions through:

• iOS Settings → Your Name → Subscriptions (for subscriptions)
• App Store → Account → Purchase History

4.4 Restore Purchases

If you reinstall the app or get a new device, you can restore previous purchases through the app's restore function or through your App Store account.

5. Payment

All payments are processed through the Apple App Store. By making contributions, you agree to:

• Pay through your App Store account
• Provide accurate billing information to Apple
• Authorize Apple to charge your chosen payment method

We do not have access to your payment information. All payment disputes should be directed to Apple.

6. Refunds

All sales are final. Refunds are handled by Apple according to their refund policy. To request a refund:

1. Go to reportaproblem.apple.com
2. Sign in with your Apple ID
3. Find your Air Mustache Man purchase
4. Select "Report a Problem" and follow the instructions

Refund approval is at Apple's discretion and subject to their policies.

7. Your Data

7.1 Data Storage

All content created in Air Mustache Man (high scores, progress, settings) is stored:

• On your device's local storage
• In your personal iCloud account (if iCloud sync is enabled)

We do not have access to, control over, or responsibility for your game data.

7.2 Data Ownership

You own your game data. All information stored in Air Mustache Man belongs to you. You can:

• Delete the app to remove local data
• Manage iCloud data through iOS Settings
• Reset game progress (if available in settings)

7.3 Data Backup

You are responsible for backing up your game data. We recommend:

• Keeping iCloud sync enabled
• Regularly backing up your iOS device

7.4 Data Loss

We are not liable for any data loss that may occur, including but not limited to:

• Device failure or loss
• iCloud account issues
• App deletion or reinstallation
• iOS updates or bugs
• User error or accidental deletion

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information. By using the App, you also agree to our Privacy Policy.

Key Privacy Points:

• We do not have access to your game data
• All data stays on your device and in your iCloud
• We do not track or sell user data
• No ads

9. Intellectual Property

The App and all its content, features, and functionality (including but not limited to the Air Mustache Man character, game design, graphics, music, and code) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement

We do not warrant that:

• The App will meet your entertainment needs
• The App will be uninterrupted, timely, secure, or error-free
• Any defects in the App will be corrected
• The App is free of viruses or other harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your game data
• Any bugs, viruses, or other harmful code
• Any content obtained from the App
• Any errors, mistakes, or inaccuracies

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• You must delete the App from all your devices
• Your data on your device and iCloud remains yours (we never had access to it)

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting the new Terms in the App or on our website
• Updating the "Last Updated" date
• Providing notice through an app update (for material changes)

Your continued use of the App after changes become effective constitutes acceptance of the new Terms.

15. Apple Requirements

This App is available through the Apple App Store. You acknowledge and agree that:

• These Terms are between you and us, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support for the App
• Apple is not responsible for addressing any claims you have relating to the App
• Apple is a third-party beneficiary of these Terms and has the right to enforce them

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App should first be addressed by contacting us. If we cannot resolve the dispute informally, you agree that any legal action or proceeding shall be brought exclusively in the courts of Sweden.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
